Terms of Service

These Terms of Service ("Terms") govern access to and use of the Carspot mobile application and the website carspot.eazy-media.fr (together, the "Service"), published by EAZY MEDIA (the "Publisher", "we"). Carspot lets you photograph vehicles, have them identified, build collections, interact with other users and receive personalised recommendations. The Publisher does not sell any personal data; only strictly anonymous, aggregated statistics may be shared as part of partnerships (Section 10).

Using the Service implies full acceptance of these Terms. If you do not accept them, you must stop using the Service.

The Service is reserved for persons aged 15 or over. The Publisher reserves the right to verify users' age. The core Service is free of charge; certain optional features belong to the paid Carspot Gold subscription (Section 9).

An account is required to use the Service. Each user is responsible for keeping their credentials confidential; any use of the account is deemed made by its holder. You must promptly report any unauthorised use to contact@eazy-media.fr. You may delete your account at any time from the app (Settings › My account); deletion is permanent.

You agree to use Carspot fairly, for personal and non-commercial purposes, in compliance with applicable laws, these Terms and third-party rights — including image rights and privacy when taking photographs in public spaces.

The following are prohibited, among others:

• fraudulent or illegal use, including manipulation of scores, rankings or rewards;
• harassment, insulting, hateful or discriminatory speech;
• posting unlawful content or content infringing third-party rights;
• hacking attempts, unauthorised access or circumvention of the Service's technical measures;
• unauthorised resale or disclosure of other people's data;
• use of automated means (bots, scripts, bulk extraction) without the Publisher's written authorisation.

You remain the owner of the content you post (photographs, comments, etc.). By posting, you grant the Publisher a non-exclusive, worldwide, royalty-free licence, for the duration of the applicable rights, solely to operate the Service: hosting, display, technical adaptation (cropping, licence-plate blurring, compression) and personalisation of your experience. You warrant that you hold the rights to the content you post. The Publisher may remove any content that breaches these Terms.

Carspot provides personalised recommendations based on your preferences and your use of the Service. They are indicative and may change without notice. Details of this processing are set out in the Privacy Policy.

9.1 Description

Carspot Gold is an optional subscription giving access to additional features and benefits (including the spot map, exclusive cosmetic content and convenience benefits) as described in the app and on the website on the day you subscribe. Carspot Gold confers no advantage in gameplay, scoring or rankings. The Publisher may change the benefits; in the event of a substantial reduction, subscribers are informed and may cancel under Section 9.7.

9.2 Price

Current prices are displayed before any subscription: as an indication, €5.99 incl. VAT per month or €49.99 incl. VAT per year. For purchases made through the App Store or Google Play, the price displayed by the store in your currency prevails.

9.3 Subscribing — two distinct channels

a) In-app purchase (Apple App Store or Google Play). The transaction is concluded with Apple or Google, acting as sellers. Their terms apply to the transaction, including billing, management, cancellation and refunds, which are handled exclusively through your Apple or Google account.

b) Direct purchase on the website (card payment through our provider Stripe). The contract is concluded with EAZY MEDIA. Subscribing requires a Carspot account. You receive a confirmation email stating the subscription's characteristics, price and renewal date.

9.4 Term and automatic renewal

The subscription is entered into for the chosen term (one month or one year) and renews automatically for successive terms of the same length, at the price in force on the renewal date, unless cancelled before the end of the current term under Section 9.6. For yearly subscriptions taken out on the website, a reminder email is sent before the renewal deadline, in accordance with Article L215-1 of the French Consumer Code (applicable to consumers residing in France), reproduced below:

"For service contracts concluded for a fixed term with a tacit renewal clause, the professional service provider shall inform the consumer in writing, by dedicated personal letter or email, no earlier than three months and no later than one month before the end of the period allowing rejection of the renewal, of the possibility of not renewing the contract concluded with a tacit renewal clause. This information, delivered in clear and comprehensible terms, shall state, in a prominent box, the deadline for non-renewal. Where this information has not been sent in accordance with the first paragraph, the consumer may terminate the contract free of charge at any time from the renewal date. Advance payments made after the last renewal date or, for open-ended contracts, after the date of transformation of the initial fixed-term contract, shall in this case be reimbursed within thirty days of the termination date, less the amounts corresponding to the performance of the contract up to that date." (Article L215-1, French Consumer Code)

9.5 Right of withdrawal (website purchase)

Carspot Gold is a digital service whose performance begins immediately after payment. In accordance with Article L221-28, 13° of the French Consumer Code, by requesting immediate access at the time of subscription and expressly waiving your right of withdrawal — which the checkout flow asks you to confirm before payment — you do not benefit from the fourteen-day withdrawal period provided for in Article L221-18. This waiver is confirmed in your order confirmation email. For in-app purchases, Apple's or Google's policies apply.

9.6 Cancellation

You may cancel at any time, free of charge and without giving reasons:

• website subscription: from the Carspot Gold page of your account (online management portal), through an electronic cancellation facility compliant with Article L215-1-1 of the French Consumer Code;
• in-app purchase: from your Apple account settings (Settings › Subscriptions) or Google Play (Subscriptions).

Cancellation takes effect at the end of the current term, which remains due; access to Gold benefits continues until that date. Amounts paid for the current term are not refunded pro rata, without prejudice to Sections 9.4, 12 and any overriding mandatory provision.

9.7 Changes to price or benefits

In the event of a price increase or a substantial change to the benefits, subscribers are informed at least thirty days before it applies at the next renewal and may cancel before that date under Section 9.6. Continuing the subscription after the change takes effect constitutes acceptance.

9.8 Termination for breach

If the account is suspended or terminated for breach of these Terms (Section 13), access to Gold benefits ends on the same terms; amounts corresponding to the period already performed remain due.

The Publisher does not sell, rent or trade any personal data, and does not transmit any identified or identifiable data to third parties for commercial purposes. Only strictly anonymous, aggregated statistics that do not allow any re-identification may be shared as part of partnerships. Data are otherwise processed by technical processors acting on the Publisher's behalf (hosting, notifications, vehicle identification, payment), under the conditions detailed in the Privacy Policy.

The Publisher uses reasonable means to keep the Service running but does not guarantee its permanent availability, the accuracy of automatically generated vehicle identifications, or the accuracy of content posted by users or partners. It shall not be liable in cases of force majeure or acts of third parties. Users remain responsible for their use of the Service and the content they post. Nothing in these Terms excludes or limits the Publisher's liability for gross negligence or wilful misconduct, or deprives consumers of rights arising from mandatory provisions.

For Carspot Gold subscriptions taken out on the website, consumers residing in France benefit from the legal guarantee of conformity for digital content and services under Articles L224-25-12 et seq. of the French Consumer Code: the Publisher must provide a service that conforms to the contract and is liable for conformity defects existing at the time of supply and appearing throughout the supply period. In the event of a defect, you may obtain the service's compliance and, failing that, a price reduction or termination of the contract, as provided by law. These rights are exercised free of charge via contact@eazy-media.fr.

The Publisher reserves the right to suspend or terminate an account in the event of a breach of these Terms or applicable law, after informing the user except in urgent cases or where legally required otherwise. Users may contest the measure at contact@eazy-media.fr.

These Terms may be amended. Users are informed of significant changes through the app at least fifteen days before they take effect; continued use of the Service after that date constitutes acceptance. Changes affecting the Gold subscription follow Section 9.7.

All elements of the Service (trademark, logos, designs, interfaces, editorial content, databases) are protected by intellectual property rights owned by or licensed to the Publisher. Any unauthorised reproduction or extraction is prohibited.

These Terms are governed by French law. If a problem arises, please first send a written complaint to contact@eazy-media.fr; we endeavour to reply within fifteen working days. Failing an amicable resolution, the dispute may be brought before the competent French courts; consumers residing in the European Union may also benefit from the mandatory consumer-protection provisions of their country of residence.
